Terms of Use for Remixes

All of the works on this website may be saved for noncommercial, personal use and enjoyment (e.g., desktop wallpaper). If you plan to use one or more of my pieces in a public (including online “public”) atmosphere, or to create a new work based off of my work, please read the applicable section(s) below.

If you’re in need of information about commercial use, please see here.

Using Blog Entries/Articles

Creative Commons BY-NC-ND LicenseMy blog entries are licensed under a Creative Commons Attribution Noncommercial No Derivative Works license. This license enables you to share any and all articles on this website in a manner you see fit, provided you give me credit (link to http://www.leliathomas.com), do not use the material for commercial gain and make no edits/derivative works with the content. You are free to republish the content, and I do not consider republishing it on sites with advertising to be commercial use.

If you would like to use my written work in a commercial endeavor, such as a magazine, please contact me. I will likely request payment and/or publication of a small bio to go with the piece.

Example Usage: Republishing one of my articles on your blog, with a link back to this website.

Using Digital Artwork

Creative Commons BY-NC-SA LicenseMy digital art pieces are under a Creative Commons Attribution Non-Commercial Share Alike license. This license enables you to republish, remix/adapt and edit my work, provided you give me credit (link to http://www.leliathomas.com) and do not use my digital artwork and/or your creation for commercial purposes. General use of your remixed work must be under this same license. If you would like to use your remixed piece commercially, please see this section.

Example Usage: Taking a Photoshop file of my work and editing it to create a new piece that is your own. Posting this piece online, with a link back to this website.

Using Photography

Creative Commons BY-NC-SA LicenseMy photography is under a Creative Commons Attribution Non-Commercial Share Alike license. This license enables you to republish, remix/adapt and edit my work, provided you give me attribution (link to http://www.leliathomas.com) and do not use my photography and/or your creation for commercial purposes. General use of your remixed work must be under this same license. If you would like to use your remixed piece commercially, please see this section.

Example Usage: Using one of my photographs as a stock photo for your latest blog entry.

Using Poetry and Short Stories

Creative Commons BY-NC-SA LicenseMy poetry and short stories are under a Creative Commons Attribution Non-Commercial Share Alike license. This license enables you to republish, remix/adapt and edit my work, provided you give me attribution (link to http://www.leliathomas.com) and do not use my creative writings and/or your creation for commercial purposes. If you would like to use your remixed piece commercially, please see this section.

Example Usage: Creating a piece of music that used one of my poems for your song’s lyrics.

Using Miscellaneous/Other Works

Occasionally, I have works that don’t really fit into the categories above. If this is the case, I recommend you look on the work’s page for licensing/copyright information, to know the terms of use for individual pieces. While most of my works are under a license that enables republishing and adaptation, some works, like my web design, are not licensed under Creative Commons and are under full copyright, with all rights reserved. If you are unsure of what one of my pieces is licensed under, or whether it is fully copyrighted, you can contact me.

Can I use my remixed creation commercially?

By default, my work is licensed under noncommercial terms. However, I do believe that any creation that has had significant work go into it is no longer just my creation. Given this, if you would like to use your remixed work for commercial purposes, submit your remix to me, and check that you want permission to use your work commercially. (Also, if you already have a remix in the gallery, but did not previously ask for commercial permission, and would like to do so now, please contact me.) Artists whose remixed works may be used commercially do not have to provide attribution to me or to the original work(s) that they built upon; however, attribution is always appreciated.

A note about using my works commercially: Any user granted permission to use their remixed work commercially will use, market and sell the work(s), as it was originally submitted to me. Any future edits to the work will need to go through the permission process again. This is to ensure my original works are not abused, and to make sure that my work does not ever become associated with anything illegal.

Zero Liability

When remixing my work, it is to be understood that I am not held liable for any issues that may arise from use of the originals. I am also not liable or to be seen in support of any illegal activities that remix artists may endorse. The simplified version of this is that remix artists are responsible for themselves and their work; I am not.
